1. Introduction
These Terms of Service ("Terms") form a binding agreement between you and WaveBump regarding your access to and use of the WaveBump websites, applications, APIs (when made available), and related services (collectively, the "Service").
WaveBump is a professional music promotion platform. The Service provides tools for promo campaigns, smart links, shared links, Discovery, audio streaming and downloads, file delivery, contact management, labels and artists, analytics, team workspaces, feedback, comments, and email distribution. Additional features, including a public API and AI-assisted tools, may be introduced over time and will be governed by these Terms unless a separate supplemental agreement applies.
By creating an account, accessing the Service, or using any WaveBump feature, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
These Terms should be read together with the Acceptable Use Policy, Community Guidelines, Copyright Policy, and Cookie Policy. If there is a conflict, these Terms control unless a specific policy expressly states otherwise for its subject matter.
2. Definitions
In these Terms:
- "Account" means a registered WaveBump user account.
- "Workspace" or "Team Workspace" means an organization or collaborative space on WaveBump (for example a label, label group, or agency) that may include multiple members with assigned roles.
- "User Content" means any content you upload, submit, import, post, or otherwise make available through the Service, including music, artwork, images, metadata, promotional material, playlists, contact databases, recipient lists, comments, and feedback.
- "Promo Campaign" means a promotional distribution workflow created on WaveBump to share music and related materials with selected recipients.
- "Smart Link" means a WaveBump-hosted landing experience that aggregates destination links and related release information.
- "Shared Link" means a link you generate to share content or campaign access with others under permissions you configure.
- "Discovery" means WaveBump features that allow eligible users to browse, preview, or engage with promotional releases made available for discovery within the platform.
- "we", "us", and "WaveBump" refer to the operator of the Service.
- "you" means the individual or entity using the Service.
3. Eligibility
You must be at least 16 years old, or the minimum age of digital consent in your place of residence if higher, to create an Account. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" includes that organization.
You may not use the Service if you are prohibited from doing so under applicable law, or if your Account has been previously suspended or terminated for material breach and has not been reinstated.
4. Accounts
To access most features you must create an Account and provide accurate, current information. You must keep your Account details up to date. Account types (such as producer, DJ, label, label group, or agency) determine available workflows and may create a Team Workspace automatically.
You are responsible for all activity that occurs under your Account, except where caused solely by a security incident that is not attributable to your negligence. One natural person should not maintain multiple Accounts to evade restrictions, limits, or enforcement actions.
By creating an Account, you agree to the then-current Terms and acknowledge the then-current Privacy Policy. WaveBump records the accepted Terms version, Privacy Policy version, and the acceptance timestamp for your Account. Material updates may require you to review revised Terms before continuing to use the Service.
5. Account Security
You must protect your credentials, authentication methods (including multi-factor authentication where enabled), and any invitation or access tokens associated with your Account or Workspace. Do not share passwords. Notify us promptly if you suspect unauthorized access.
WaveBump may implement security measures such as session management, login activity records, device trust controls, and verification requirements. You agree to cooperate reasonably with security investigations related to your Account.
6. Team Workspaces
Team Workspaces allow multiple members to collaborate under shared resources, such as campaigns, contacts, labels, and analytics, subject to roles and permissions configured within the Service.
Workspace owners and administrators are responsible for: (a) inviting only authorized people; (b) assigning appropriate roles; (c) User Content submitted by members of the Workspace; and (d) ensuring Workspace use complies with these Terms and applicable law. Actions taken by Workspace members may be attributed to the Workspace and its controlling Account for enforcement purposes.
If you leave a Workspace, you may lose access to Workspace-owned content. Removing a member does not automatically delete historical activity logs or content already distributed outside WaveBump.
7. Subscription Plans
WaveBump may offer free and paid subscription plans with different feature limits (for example campaign volume, storage, team seats, or analytics depth). Plan details displayed in the Service or at checkout describe the features included for each plan.
We may change plan features, limits, or pricing prospectively. Where a change materially reduces paid entitlements mid-cycle, we will provide notice through the Service or by email where practicable. Continued use of a paid plan after the effective date of a change constitutes acceptance of the updated plan terms for subsequent billing periods.
8. Billing
Paid plans renew automatically for the selected billing period unless cancelled according to the cancellation controls in your Account or as otherwise stated at purchase. Taxes may apply based on your location and billing information.
Failure to pay amounts due may result in downgrade, suspension of paid features, or Account restrictions until payment is resolved. Chargebacks initiated without first contacting WaveBump support may be treated as a billing dispute and may lead to temporary access limits while investigated.
9. Payments
Payments may be processed by third-party payment providers. WaveBump does not store full payment card numbers on its servers when those providers handle checkout. Your use of a payment provider is also subject to that provider's terms.
Unless required by applicable law or expressly stated at purchase, fees are non-refundable once a billing period has started. If you believe a charge was made in error, contact us promptly with supporting details.
10. Trial Accounts
WaveBump may offer trial, demo, or promotional access with limited features, duration, or usage caps. Trials are provided to evaluate the Service and may be modified or ended at any time. Converting a trial to a paid plan may require payment method confirmation.
Data created during a trial may be retained or deleted according to the retention practices described in these Terms and the Privacy Policy when the trial ends, unless you convert to a continuing Account.
11. User Content
You retain ownership of your User Content, subject to the licenses and permissions needed for WaveBump to operate the Service. You are solely responsible for User Content you submit, including:
- uploaded music and audio files
- artwork, images, and visual assets
- metadata (titles, credits, identifiers, descriptions, and similar fields)
- promotional material and campaign copy
- playlists and curated lists
- contact databases and recipient lists
- comments, feedback, and other communications submitted through the Service
You represent and warrant that:
- you own or have obtained all rights, licenses, consents, and permissions necessary to upload, process, distribute, and publicly perform or display the User Content as configured in the Service
- your User Content and your use of the Service do not infringe intellectual property, privacy, publicity, or other rights of any person
- contact and recipient data was collected and is used in compliance with applicable anti-spam, privacy, and marketing laws
- User Content is accurate to the best of your knowledge where accuracy is material (for example rights credits and identifiers)
You grant WaveBump a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, and distribute User Content solely as needed to operate, secure, improve, and provide the Service and related support. This license is limited: WaveBump does not claim ownership of your music or other User Content, and the license ends when User Content is deleted from WaveBump systems, subject to residual copies in backups and logs that are purged in the ordinary course, and subject to content already delivered to recipients outside WaveBump.
12. Intellectual Property
The Service — including software, design, trademarks, logos, documentation, and WaveBump-created materials — is owned by WaveBump and its licensors. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
You may not copy, modify, reverse engineer, or create derivative works of the Service except to the extent such restriction is prohibited by applicable law. Feedback you provide about the Service may be used by WaveBump to improve products without obligation to you.
13. Promo Campaigns
Promo Campaigns allow you to package and distribute promotional music and related materials to selected recipients. You control campaign settings, recipients, access rules, and available actions (such as streaming or download permissions), within plan limits and platform rules.
WaveBump provides tools for music promotion. WaveBump does not guarantee email delivery, downloads, feedback, campaign success, chart positions, playlist placement, streaming growth, press coverage, or any commercial outcome. Results depend on many factors outside WaveBump's control, including recipient behaviour, third-party platforms, and the quality and rights status of your content.
14. Smart Links
Smart Links help you present destination URLs and release information in a WaveBump-hosted experience. You are responsible for the accuracy of linked destinations and for ensuring that linked services and content are lawfully available to your audience.
WaveBump is not responsible for third-party storefronts, streaming platforms, or websites linked from a Smart Link, including their availability, pricing, or policies.
16. Discovery
Discovery features may surface promotional releases to eligible listeners or industry users within WaveBump. Availability of Discovery, eligibility rules, and visibility of campaigns may change as the product evolves.
Submitting content to Discovery does not guarantee placement, prominence, feedback, or any particular audience. WaveBump may remove Discovery listings that violate these Terms, the Community Guidelines, or the Copyright Policy.
17. Contact Lists
You may maintain contacts and groups inside WaveBump for promotional outreach and Workspace collaboration. You are the controller of personal data in contact databases you import or create, except where WaveBump acts as an independent controller for its own Account and platform operations as described in the Privacy Policy.
You must not upload contact lists obtained unlawfully, purchased without lawful basis for marketing, or known to include individuals who have opted out of your communications where such communications would be unlawful.
18. Email Distribution
Email distribution features send messages you authorize to recipients you select. You are responsible for message content, sender identity, unsubscribe handling where required, and compliance with applicable electronic marketing laws.
WaveBump does not guarantee inbox placement, open rates, or delivery to every recipient. Delivery may be affected by recipient servers, spam filters, bouncing addresses, rate limits, and reputation factors. WaveBump may throttle, block, or refuse sends that appear abusive, unlawful, or harmful to platform deliverability.
19. Downloads & File Delivery
Where enabled, the Service may allow streaming, downloading, or other file delivery of audio and related assets to authorized recipients. You are responsible for setting download permissions and for ensuring you have rights to permit those actions.
WaveBump does not guarantee that every authorized recipient will successfully download files, nor that downloaded files will remain within recipient control after delivery. Recipients may act outside WaveBump once content is in their possession.
20. Analytics
WaveBump provides analytics related to campaigns, links, engagement, and other platform activity. Analytics are provided to help you understand usage of the Service. Figures may be approximate, delayed, sampled, or dependent on third-party signals.
Analytics are not a warranty of performance and should not be treated as certified industry chart data or audited commercial reports unless expressly labelled as such.
21. User Feedback
Recipients and users may submit feedback on promotional materials where the feature is enabled. Feedback reflects individual opinions and is not endorsed by WaveBump. WaveBump does not guarantee that feedback will be provided, constructive, or commercially useful.
23. Moderation
WaveBump may remove, edit, restrict, disable, hide, or suspend User Content or Accounts whenever reasonably necessary to: enforce these Terms; enforce the Community Guidelines or Acceptable Use Policy; comply with applicable law; protect users; protect the platform and its infrastructure; investigate abuse; or respond to legal complaints (including copyright complaints under the Copyright Policy).
WaveBump reserves discretion to moderate content and access while acting reasonably and consistently with applicable law. Moderation decisions may be based on reports, automated signals, manual review, or legal requests. Where practicable, we may notify the affected Account of significant enforcement actions, but we are not obligated to do so in every case (for example where notice would hinder an investigation or violate law).
24. Service Availability
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted, error-free, or fully secure operation. Maintenance, outages, force majeure events, dependency failures, and security incidents may affect availability. Features may differ by plan, region, device, or account status.
25. Beta Features
WaveBump may designate features as beta, preview, experimental, or early access. Beta features may be incomplete, change without notice, or be withdrawn. They are provided as-is and may be subject to additional usage limits. Future API access and AI-assisted functionality, if offered, may initially be released as beta features.
26. Suspension
We may suspend access to the Service, a Workspace, or specific features if we reasonably believe you have violated these Terms, pose a security or legal risk, fail to pay fees due, or if suspension is required to protect the Service or other users. Suspension may be temporary while we investigate.
27. Termination
You may stop using the Service at any time and may request Account closure through available Account settings or by contacting support. WaveBump may terminate Accounts for material breach, prolonged inactivity where permitted, legal requirement, or discontinuation of the Service.
Upon termination, your right to access the Service ends. Provisions that by their nature should survive (including intellectual property ownership, disclaimers, limitations of liability, indemnification, and accrued payment obligations) will survive termination.
28. Data Retention
After Account closure or content deletion, WaveBump may retain certain data as described in the Privacy Policy, including for security, dispute resolution, legal compliance, backups, and auditability. Distributed copies already sent to recipients are outside WaveBump's control once delivered.
29. Disclaimer
To the fullest extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis. WaveBump disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising from course of dealing or usage of trade, except where such disclaimers are not allowed.
Without limiting the above, WaveBump does not warrant that promotion tools will achieve any particular commercial, chart, playlist, or audience result.
30. Limitation of Liability
To the maximum extent permitted by applicable law, WaveBump and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or cost of substitute services, arising out of or related to the Service or these Terms, regardless of theory of liability.
To the maximum extent permitted by applicable law, WaveBump's total aggregate liability for all claims relating to the Service or these Terms will not exceed the greater of: (a) the amounts you paid to WaveBump for the Service in the twelve (12) months before the event giving rise to liability; or (b) fifty euros (EUR 50) or the equivalent in local currency if you have not paid any fees.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence where such limitation is prohibited.
31. Indemnification
You will defend, indemnify, and hold harmless WaveBump and its personnel from and against claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) your use of the Service; (c) your violation of these Terms or applicable law; or (d) disputes between you and recipients, collaborators, or other third parties regarding rights in music or promotional materials.
32. Changes to the Service
We may add, modify, or discontinue features of the Service. Where a change materially removes paid functionality, we will provide reasonable notice where practicable. We may also impose new technical requirements for security or compatibility.
33. Changes to these Terms
We may update these Terms from time to time. The Effective Date, Last Updated date, and version number appear at the top of this document. For material changes, we may require you to review and accept the updated Terms before continuing to use the Service, and we will update the recorded accepted version on your Account when you do so.
If you do not agree to updated Terms, you must stop using the Service and may close your Account. Continued use after the effective date of non-material updates constitutes acceptance of the revised Terms.

22. Comments
Where commenting is available, comments must remain relevant to music promotion and the content under discussion. Comments must not contain harassment, threats, hate speech, discrimination, unrelated political campaigning, extremist content, spam, pornography, malware, illegal material, copyright-infringing material, or impersonation.
Detailed behavioural expectations are set out in the Community Guidelines. Prohibited technical and operational misuse is further described in the Acceptable Use Policy.
